Terms and Conditions (the boring bit)
Booking Fee: A 25% non-refundable booking fee is required when the client signs and returns the booking contract. Dates are reserved only when this is paid. The booking fee will be subtracted from the total cost of the package. Once you have secured your booking with Flashpoint Photography you must inform us of any changes, such as venue changes, times, address or telephone numbers as soon as possible.

Payment & Prices: Payment for the balance is required no later than 7 days prior to the Assignment date. All payments must me made by cheque or cash. Any bank charges that are incurred due to refusal of a cheque will be charged to the client. (all cheques will be made payable to Jason Spickett) All costs are as stated at the time of booking & will remain once booking is confirmed. Additional photographs will be charged at the cost in force at the time of ordering. We reserve the right to increase our prices at any time.

Cancellation: If cancellation occurs 4 weeks prior to the assignment the balance is to be paid in full, 5-8 weeks = 75% of the total fee, 8-10 weeks = 50% of the total fee. Any cancellation will result in loss of the initial deposit.

Proof Book and Photographs: All of the photographs that we take are presented to you in the form of a returnable A4 Proof book, with each page showing 4 images. All pages are printed onto RA4 photographic paper. The proof book is held for a maximum of 4 weeks after which it should be returned with your completed order. All proof books and images within remain the property and copyright of Flashpoint Photography. Please state whether you would prefer gloss or matt photographs. If this is not clearly stated all photos will be supplied with a gloss finish.

Storage: We store 2 CD copies from each assignment. However, although we take all necessary precautions to ensure the safety and security of the CD's Flashpoint Photography cannot be held responsible for any damage, loss or corruption to any files or discs due to circumstances beyond our control.

Travel: Assignments outside of a 30 mile total radius will incur a charge of 40p per mile. Flights and overnight accommodation will be charged at cost to the client if necessary. Parking fees and the Congestion Charge will be charged to the client after the assignment has been completed where appropriate.

Sole Rights: Flashpoint Photography shall be the sole Professional Photographer at the assignment and will be granted full artistic licence in relation to the photographs taken. The decision made by the photographer/s regarding location, poses etc. shall be deemed correct.

Coverage: The photographer/s will not be held responsible for the lack of coverage caused due to the following reasons: the individuals or groups not being on time. Individuals or members of a group or party not making themselves available when called for a shot. If the event or occasion is running late or because of restrictions regarding photography at a desired location. The photographer/s with the co-operation of the client will do their best to produce coverage within the time scale allocated to them.

Requested Photographs: The photographer/s will do their best to honour all requested photographs requested by the client providing that the following factors are met: weather and allocated time permitting and the availability and co-operation of the person/s concerned. All requested photographs must form part of the client’s final order or the client will incur an extra charge for each requested photograph taken and not purchased. Failure to obtain requested shots does not entertain any discounts, refunds or invalidation of any contract made with
Flashpoint Photography or the business proprietor.

Weather: Weather permitting all photographs will be taken as agreed. In the event of rain, snow or other form of weather disturbances, the photographer/s will make the necessary changes regarding the photographs and will not be held responsible for any disappointment caused by the weather or venue limitations. In dark situations or areas where we are unable to use flash the photographs may appear 'grainy' due to a higher speed setting or ISO which we will have to use to compensate in such situations. We will do our best to avoid such situations but it may happen in some cases where light is limited and flash prohibited.

Photo-chromatic Anomalies: Owing to the reflectance cause by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact colour of materials as seen by the human eye. The photographs should provide a pleasing colour balance based on flesh tones. Exact colour matching from the original photographs, negatives or files cannot be guaranteed on any reprints. Colours will try to match the original photographs but may vary slightly.

Force Majeure: Whilst every care is taken this contract is subject to alteration or cancellation without prior notice by Flashpoint Photography or the business proprietor owing to any cause/s beyond our control, i.e. act of god, Fire, War, Terrorism, accident, serious illness vehicle breakdown or road closure ; we will do our best to avoid any possible situations. If the worst should happen then Flashpoint Photography and the business proprietor will be liable for no more than a refund of all monies paid. Neither party shall be liable for any indirect or consequential loss of any kind.

Limitation of Liability: In the unlikely event that all or some of the photographs fail to materialise or if there is a total photographic failure due to equipment breakdown or other reasons beyond our control the liability of Flashpoint Photography and the business proprietor will be limited to only the refund of all monies paid. Neither party shall be liable for any indirect or consequential loss of any kind.

Copyright: The copyright of all photography belongs to Flashpoint Photography and it is a criminal offence to copy or reproduce any of the photographs by any means, including video, under the terms of the Copyright, Designs and Patents Act 1988. Failure to correspond may result in legal action. All original images, such as negatives, digital files and proof books remain the property of Flashpoint Photography. We keep all digital material and any other digital files indefinitely unless otherwise stated or other arrangements are made, such as sale of files.

Other: By signing a contract permission is granted for all photographs to be displayed and used by Flashpoint Photography for competitions, advertising and for our online website presence. We will however endeavor to contact you for these purposes if necessary. Flashpoint Photography may contact you in the future to inform you of any promotions or special offers.

In the unlikely event that the client should have a complaint or query the client must contact the photographer/s in writing within 14 days upon receipt of the images.
